Terms & Conditions

1.  PARTIES AND AGREEMENT  

 

1.1.  The offeror of the games, Hitz Gaming OÜ, company identification number: 16217486 address: Pärnu mnt 31-66, Tallinn, 10119, Estonia (Operator) is a business entity, operating the Hypekasino.com site in Estonia (Website).

1.2. The Operator offers services under the licenses for organising online gambling for an unspecified term from Estonian Tax and Customs Board, license numbers: HKT000062, from 8th of October 2021, HKL000371, from 9th December 2021 and license No: HKT000073, from 3rd of January 2023.     
 

1.3. The Customer (or "You") must be a private individual who is at least 18 years of age, or of the legal age permitted to gamble in the applicable jurisdiction—whichever is higher. The Customer must be registered and accepted as a gaming customer of the Operator. To use the gaming services provided by the Operator, the Customer must have deposited funds into the Operator's designated bank account.

 

1.4. The games offered by the Operator are: Casino, Live Casino, Jackpot Games, and other games as may from time to time become available on the Website.

 

1.5. Member Account on the Website is intended for administration of the Customer's gaming expenses, for refunding and payment of wins by the Operator. The Member Account may only be used to participate in the Gaming Service. The Operator reserves the right to limit payments into the Member Account at any time for security reasons.         
 

1.6. By using the services provided by the Operator the customer agrees to the operator's Terms and Conditions and Privacy Policy.

 

2. MEMBER ACCOUNT

 

2.1.  The method available for deposits, withdrawals and registration of Member Accounts on the Website shall be done via direct banking verification system or other means available to your location. You must verify your identity either by using electronic-issued IDs (ID Card, Smart ID, Mobile ID, eID issued by credit or payment or other regulated institutions, etc.) or through the Sumsub user verification system to be able to play on the Website. The deposit shall be made by the customer only from personal bank account belonging to the same customer and to your personal account on the Website (Member Account). The Operator will open the Member Account automatically upon receiving the deposit in case the customer complies with the Terms & Conditions. Deposits are only allowed for playing games on the Website.      
 

2.2. You hereby represent and warrant that:

 

  • You are over 21 years of age or of the legal age allowed to gamble in the respective jurisdiction, whichever is lower;
  • You are not restricted by limited legal capacity;
  • You are not acting on behalf of another party;
  • You are not a compulsive player;
  • You have not added yourself to the list which defines gambling restrictions for you as an individual (known as “HAMPI”);
  • Only you have access and are using the Member Account;
  • You are not depositing money originating from criminal and/or other unauthorised activities into the Member Account;    
  • You are not conducting criminal activities directly or indirectly in relation to the Member Account;    
  • You inform the Operator immediately in case you are or become a politically exposed person (PEP) and agree to undergo enhanced due diligence procedures of the Operator.         
     

2.3. It is your responsibility to ensure that operations comply with all laws in force in the jurisdiction in which you are using the Operator's service. If you are in a country where remote gambling is prohibited, you may not use the services of the Operator.         
 

2.4. The Operator may request additional identification documents at any time, e.g. a copy of an identification document or a document serving as a proof of address.

 

2.5. Your Member Account may be blocked or closed if You do not provide requested additional information or documents or if such information or any of such documents you supply are found to be false, misleading, incomplete or are of poor quality.

 

2.6. The Customer gives his/her permission for the registration, processing and saving his/her personal data in Operator's online customer register.

 

2.7. The Operator shall treat and process all personal data and documents in accordance with valid law and requirements related to licenses.    

 

2.8. The Operator reserves the right to limit payments in connection to Member Account at any time for security reasons or for other grounds on the basis of the law.

 

2.9. The Operator shall not issue any certificates or receipts regarding individual entries onto the Member Account. The entries shall be entered electronically in the gaming service.

 

2.10. It is your sole and exclusive responsibility to ensure that your login details are kept securely. You must not disclose your login details to anyone. The Operator is not responsible for any abuse or misuse of your Member Account by third parties due to your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.

 

2.11. The Operator shall not provide the details of your Member Account via Live Chat.

 

2.12. In case You will not log in or access your Member Account for an uninterrupted period of 6 months, Your Member Account shall be classified as an inactive account.

 

2.13. Inactive accounts shall be charged an administrative fee in the amount EUR 5.00 or equivalent currency per month. You will receive an email notice 30 days prior to the first deduction of the administrative fee. Once Your Member Account balance reaches zero funds, the administrative fee will no longer be charged and the Member Account shall be closed.


2.14. Should You reactivate Your Member Account, by making one or more wagers, within 6 months from the moment the administrative fee for a given month was deducted from your Member Account, the Operator will refund any deducted administration fees within 72 hours.

 

2.15. To recover funds from inactive, closed, blocked or excluded accounts, You need to contact Customer Support with the relevant request.

 

2.16. If Your Member Account has been suspended or blocked for more than 6 months, in accordance with the clauses 2.5 and/or 12.1, the Operator reserves the right to charge a monthly administrative fee of EUR 5.00 or equivalent currency per month until the Member Account is unblocked or the balance reaches zero. The Operator shall close the suspended or blocked Member Account once the account reaches zero balance.

 

3. DEPOSITS

 

3.1. You may participate in games only if you have sufficient funds on your Member Account for such participation.

 

3.1.1. By depositing funds, you confirm that the payment method belongs solely to you and that you are the rightful owner of the funds.

 

3.2. All information regarding different deposit options can be found within the Deposit page on the website. Deposits can be made only in euros. Minimum deposit amount is 20 euros.

 

3.3. You are responsible for all expenses that the bank may possibly debit for the payments made regarding the Operator's bank account or for the credit transfers made between the accounts of the Operator, other external transaction providers and the customer.         
 

3.4. The Operator will carry out additional verification procedures and the identification of the customer will be checked for any deposit/withdrawal or number of deposits/withdrawals which cumulatively amount to or exceed the equivalent of €2,000 during one month and reserves the right to carry such verification procedures in case of lower deposits/withdrawals.         
 

3.5. The Operator is not responsible for any additional fees that may be incurred in connection with deposits made in a currency other than the currency of the player's account. Conversion fees and currency exchange fees may apply.         
 

3.6. The Operator is obligated to check all transactions to prevent money laundering and terrorist financing.         
 

3.7. Funds deposited by the Customer are accountable funds and the Operator shall keep customer's funds separate from its own funds.         
 

3.8. The Operator shall not pay any interest on funds transferred into the Operator's bank account by the Customer.

 

4. BONUSES

 

4.1. Deposit bonuses, free bets, risk free bets, free spins and any other bonuses can only be received and wagered once per person/account, family, household, address, e-mail address, credit card number, device, IP addresses and environments where computers are shared (university, fraternity, school, public library, workplace, etc.). Offers which are directed at new customers (for instance slots boost campaigns or some of the above-mentioned bonus types) are counted as welcome offers. Welcome offers can only be used once per person/account, family, household, address, e-mail address, credit card number, device, IP addresses and environments where computers are shared (university, fraternity, school, public library, workplace, etc.). The Operator reserves the right to close your Member Account and confiscate any existing funds if evidence of abuse/fraud is found.

 

4.2. The maximum bet with an active first and second deposit bonus is €5. Max bet allowed with other bonuses can differ.

 

4.3. It is forbidden to purchase bonus games / double up / "gamble" in slots if you have an active bonus, because max bet allowed for an active bonus will be exceeded. If a player is betting more than allowed per bet with an active bonus, it classifies as bonus abuse. This type of game-play is only allowed with special agreement.

 

4.4. If you exceed the max. bet limitation while wagering bonus money, the system will automatically remove your bonus balance to your last deposit amount, and it will be returned to your balance at the moment when the wagering process should be complete.

 

4.5. Bonuses might have wagering requirements attached to them. These requirements will be appropriately displayed before the Customer decides to use a bonus when wagering requirements are applicable. Withdrawal amounts will be only possible for the real money balance; the bonus money balance upon withdrawal will be lost. The Operator has the right to choose which game and service contributes what amount to the wagering requirements. The wagering requirements have a minimum of 25 times the amount of bonus and the real money sum contributing to the bonus figure. The minimum deposit to get bonus unlocked is €20 excluding the cases when the other minimum deposit amount is specified in Terms&Conditions of the chosen bonus. T&C of different bonuses may differ, please read bonus T&C every time you choose a bonus.

 

4.6. When you cancel an active bonus you will lose all your bonus money. When you make a withdrawal all your active bonuses will be canceled and your bonus money will be lost during the withdrawal process. If you make a new deposit with a new bonus, your previous bonus balance will be lost. All the bonuses at Hypekasino are sticky: all the bets are made from the real balance, all the winnings are credited to the bonus balance. If you activate a bonus you have to wager it. Support Department agents are technically not able to add your canceled bonus again with the same wagering level.

 

4.7. We have a zero-tolerance policy towards inappropriate play and fraudulent activity. While playing with an active bonus, it is forbidden to engage in activities that give a player a clearly unfair advantage. Such activities include, but are not limited to: delaying game rounds in any game, including free spins and bonus features, to a later time when you have no wagering requirements; leaving large bets on the table, for example, in blackjack, and returning to the game after bonus wagering has been completed; playing games with bonus money to build up in-game value, complete the wagering, and then cash out on the built-up value during real-money play; using strategies that take advantage of any software bug or failure.

4.8. If a player wants to continue playing without bonuses after a new deposit, he should make sure that there are no active bonuses at his account before depositing.

 

4.9. If a player has a bonus balance of less than €10, then the old bonus will be automatically canceled on a new deposit. The bonus balance will burn out and if the bonus includes Free Spins - they will no longer be available.

 

4.10. Some games can't be played with Bonus balance due to their game design. These games will not be displayed in the game lobby. *The following games can’t be played with bonus: All roulette games, All blackjack games, All Baccarat games, All Live games, All slot games with progressive game design (stateful).

 

4.11. Casino reserves the right to disable any Member Account from loyalty system / bonuses / cashback.

 

4.12. If You have an active balance or bonus at the time of automated cashback distribution, the cashback will not be credited to Your account.

 

4.13. The Operator reserves the right to offer specific bonuses or cashback campaigns to an individual Customer or a group of Customers. Similarly, the Operator reserves the right to exclude individual Customers from future bonuses and campaigns. Exclusion may be lifted at the discretion of the Operator.

 

4.14. Any kind of cashback or loyalty reward that the Operator may credit to a player is fully owned by the Operator. These rewards can be subjected to certain restrictions that are left to the discretion of the Operator. In case an account is subjected to a restriction (e.g. account block, deposit limits, loss limits, etc.), cashback or loyalty cash rewards may be unavailable for that account. Cashback spins and money shall be available for only 60 days.

 

4.15. Voting Bonus or No Deposit Affiliate Bonus Rules: 

1. You must complete your profile information in full.

2. You must vote for our casino on the partner site and provide a screenshot as proof that you voted.

3. Support agents will credit the bonus to your account within 24 hours. Bonuses are issued on a first-come, first-served basis.

4. If your account shows any matches with other accounts, the bonus will not be granted.

5. To withdraw winnings, you must make a minimum deposit and complete account verification.

6. The maximum withdrawal from a voting or no-deposit affiliate free spins bonus is €50 or the equivalent in another currency. Any winnings above this amount, without a real money deposit, will be voided and retained by Hypekasino.

Example: A customer receives a voting or no-deposit affiliate free spins bonus, plays the free spins, and wins €10. They continue to play with these funds and win an additional €90, bringing the total to €100. In this case, only €50 will be available for withdrawal, and the remaining €50 will be retained by Hypekasino.

 

5. WITHDRAWALS

 

5.1. In-game winnings shall be visible on your Member Account automatically.         
 

5.2. The information regarding withdrawal options from Member Account to a personal bank account can be found under the withdrawals page on the Website.

 

5.3. Payments can only be made to the customer's personal bank account using the same method as for a deposit. Payments to third party bank accounts are prohibited. The Operator has the right to require the Customer to submit additional identity documents to confirm that the account belongs to the Customer.    

 

5.3.1. We will make reasonable efforts to honor your preferred payment method and currency for withdrawals. However, we cannot guarantee this.
Withdrawals may be processed using an alternative method (e.g., a different payment provider, bank draft, or wire transfer). Any associated charges are detailed on the Website.
Additionally, the withdrawal currency may differ from your deposit currency. If currency conversion is required, the exchange rate applied will be at our sole discretion.

5.4. Before confirming the payout, the Operator has the right to demand a one-time play from the player in the amount equal to the player's previous deposit (s).    

 

5.5. The Operator has the rights to check all the transactions to prevent money laundering and terrorist financing, certain delays can happen due to these checks.

    

5.6. The Operator shall send the withdrawal request to the bank within 48 hours of receiving the withdrawal request from the customer.         

5.7. The Operator is not responsible for any damages that may occur due to payment delays or other delays due to these checks.         
 

5.8. The Operator is not responsible for extra fees which may arise in connection with using the services of credit and financial institutions.         
 

5.9. Winnings cannot be exchanged or cashed in for another prize.

 

5.10. If you have any questions about taxes or legal issues, you are advised that the gaming customer should contact an advisor or the authorities in the country in which the customer resides.         
 

5.10.1. Standard withdrawal limits upon registration:

  • €500 per day
  • €1,500 per week
  • €3,000 per month

Withdrawal limits are directly tied to your loyalty level. The higher your level, the higher your applicable limits. Exact limits vary by loyalty tier and are applied automatically as you progress. These will be clearly displayed in your account when your loyalty level increases.

 

5.10.2. If a customer requests a withdrawal without reaching the minimum turnover threshold (3x), Hypekasino reserves the right to charge a fee of 10% of the requested withdrawal amount. This fee will be deducted immediately after the withdrawal is approved.

 

5.10.2.1. If the minimum wagering requirements for a single deposit are not met in accordance with rule 5.10.2, and the customer makes a new deposit while still having an active balance from the previous deposit, the minimum wagering requirements will apply to both deposits. A new deposit does not cancel the wagering requirements of a previous deposit. 

Example:
If a customer deposits €500 and then makes a new deposit of €20 without meeting the 3x turnover requirement, the total wagering requirement becomes €1,560 (€500 × 3 = €1,500 + €20 × 3 = €60).

The minimum turnover threshold is 3x for slot games and 5x for all other games.

 

5.10.3. The Operator reserves the right to apply individual withdrawal fees for specific customers and customer groups based on multiple inner factors and parameters.         
 

5.10.4. In the cases mentioned below, the Operator may review the validity of the customer's winnings via additional check-ups from technical department and/or through requesting game-play analysis from the game provider.          

1) Win that exceeds 5000 times the bet. For example: if a customer bet is made for €0.10 and the win is €500.00 from this bet (0.10x5000).          

2) Win that is equal to or more than €10,000. The bet amount is not taken into account.          

3) Total balance on the customer's account, at the moment of withdrawal request, equals €50,000 or more.          

4) In cases when the player's win is equal to the maximum potential of the slot. For example, the player wins 5000 times his bet on Fruit Party, which is the maximum amount of multiplier in the particular game.         

These additional check-ups could take up to 7 working days and this information will be communicated to the customer.  

       
6. LIABILITY

 

6.1. The Operator is not liable for any downtime, server disruptions, lagging, or any technical or political disturbance for the gameplay. Refunds may be given solely at the discretion of management on a case- by-case basis. Refunds are processed within 72 hours after the decision is made. 6.2. The Operator shall not accept any liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with the Website or its content; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the site or its content or any errors or omissions in content.

 

6.3. The Operator reserves the right to declare the gaming event of the customer void, should it become evident that, for example:

 

  • It has been offered, requested or accepted on the grounds of an error;
  • The customer or third parties acting in cooperation with the customer jointly intend to evade the Terms and Conditions;
  • The customer is disqualified from participating in gaming events in which the customer or other party acting in cooperation with the customer may directly or indirectly influence the end result;
  • and/or the outcome of the event has, directly or indirectly, been influenced through illegal activities.         
     

6.4. The following behaviours, amongst the other things, are strictly forbidden in relation to the gaming service:

 

  • Gaming manipulation or illegal payments;
  • Use of external gaming assistance programs;
  • Use of software that will play on behalf of the customer or guide the customer on how to play;
  • Any attempt to change, modify, disassemble, reverse engineer or in some other way attempt to determine how the program is built;
  • Any other fraudulent activity or event, regardless of its end result.

 

6.5. You are not entitled to funds or any other benefits that have been obtained through fraudulent activity or violation of the gaming rules or the Terms and Conditions of this agreement, criminal activities, manipulation of the gaming system, or by any other inappropriate means.         

6.6. You hereby acknowledge and agree that in no event shall the Operator be liable for any direct or indirect damage, including but not limited to, delay, damages caused by unused opportunity of the gaming service, loss of profits, loss of reputation, goodwill, licenses of data or other financial loss arising out of the use of gaming service.         
 

6.7. The Operator exempts itself from any claims for damages relating to the gaming service's access, function, quality, possible errors such as spelling errors, bugs and other factors relating to the gaming service.         
 

6.8. The Operator shall not be liable for any damages whatsoever arising out of force majeure.

 

7. RESPONSIBLE GAMING

 

7.1. The Operator's purpose is to provide entertainment. Our aim is to provide you with a safe, secure regulated environment. We expect our clients to use our services responsibly and in a reasonable manner.         
 

7.2. You are not obligated to participate in any games, any play is entirely at the customers choice, decision and risk. The Website and the games are provided without any warranty whatsoever, whether expressed or implied.

 

7.3. The Operator strictly follows the laws of the Republic of Estonia. The services of the operator cannot be used by persons who have imposed a ban on gambling through the Estonian Tax and Customs Board. In any case of suspicion, the Operator reserves the right to ask the Customer for any additional documents and close the customer's Member Account if necessary.         
 

7.4. The customer can enable a cool-off period at any time. If the customer feels that their gambling behavior is becoming problematic, a short break can help them regain focus and avoid impulsive decisions. To do so, customers can set a cool-off period under the My Account section.

7.5. The operator kindly requests that you register your email address in your 'profile' before requesting an exclusion, to ensure responses in a timely manner.         
 

7.6. If after reviewing the self-exclusion options available on site, you decide that you would like a different account closure, please state this in your request to the operator.

 

7.7. Under no circumstances can this decision be revoked or withdrawn if the Customer's application has been approved by the Operator. When the cool-off period in the customer's application has expired, the Member Account will be opened automatically. A member account closed for life will remain closed forever. The player account game restriction is activated if confirmed by the Operator.         
 

7.8. As an alternative to the above restriction, the customer may limit their consecutive playing time or possible financial loss.

 

7.9. The customer can set a time limit on their gaming account. By choosing a time limit for their play, players will be notified of the length of their session.         
 

7.10. The time limit selected by the player applies immediately after it is set, which is also indicated by the clock counting down the time until the limit expires.         

7.11. You may choose a loss limit over a period. The loss limit shall mean net loss limit, meaning that You may choose to set a loss limit over a certain period. The loss limit stands for the amount that can be lost from the initial amount from the start of the session for a day, week or a month. Your casino loss limits start from the moment they are first set.

 

  • Daily loss limit
  • Weekly loss limit
  • Monthly loss limit

 

7.12. The customer can reduce his loss limit at any time. The reduction of the loss limit shall take effect immediately. The customer may increase or remove his loss limit at any time, and these changes will take effect after 48 hours.

 

7.13. Depending on the Customer's country of residence, the Customer may also be able to set a limit on deposits to their player account.

 

7.14. The Customer may at any time request the closure or freezing of their Member Account for a specified period of time. If the freezing is performed more than three times during a calendar year, the Operator has the right to delete the Member Account.         
 

7.15. You can also choose to self-exclude yourself from playing with any operator (land-based or online) licensed in the Republic of Estonia by submitting an application to EMTA. (in Estonian: hasartmängu mängimise piirangutega isikute nimekiri or HAMPI nimekiri), this is available only for residents of Estonia.

 

7.16. The Operator reserves the right to delete a passive Member Account which is not used for 12 months.         
 

8. GENERAL TERMS

 

8.1. You shall always follow the applicable gaming rules for all games that are provided by the gaming service in addition to the Terms and Conditions of this Agreement. Any breach of the gaming rules or the Terms and Conditions of this Agreement         
will automatically mean that the gaming event is declared void and the Customer will forfeit their entitlement to any winnings from any such void games. The Operator reserves the right to declare games void at any time during the customer relationship         
as a result of the customer's breach of the Terms and Conditions of this Agreement or of the rules.

 

8.2. If the customer discovers a bug, or any other error in the system, he/she must immediately log out from the gaming service. The customer may never benefit from a bug or error in the gaming system. The customer is obligated to immediately notify the Operator after having detected a bug, forbidden behaviour, or any other error on, or in connection to, the gaming service.         
 

8.3. The Operator reserves the right to declare the gaming event of the customer void, entirely or partly, should it become evident that, for example:

 

  • the gaming event has been offered, requested or accepted on the grounds of an error;
  • the customer or third parties acting in cooperation with the customer jointly intend to evade the Agreement;
  • the customer is disqualified from participating in gaming events in which the customer or other party acting in cooperation with the customer may directly or indirectly influence the end result;
  • and/or the outcome of the gaming event has, directly or indirectly, been influenced through criminal activities.         
     

8.4. You must personally perform all actions with regard to the Member Account and all payments to the account shall be made solely for the benefit of the customer. Third parties may not be given access to the gaming service through the customer's Member Account.

 

8.5. The customer is not allowed to create more than one player account. If the Customer creates more than one account, the account (s) may be closed and the funds in the account may be confiscated by the operator.

 

8.6. By default upon registration of a player account, the account is subscribed to all possible marketing channels (including but not limited to phone calls, sms, emails) depending on the players jurisdiction. Player may modify the selection under the My Account section.         
The operator wants to remind the customer that forgery is severely punished by law and in cases of suspicion of placing a counterfeit or an edited copy of the documents by electronic methods, The Operator reserves the right to send such documents to the appropriate regulatory authorities.    

 

9. LIVE CHAT RULES

 

9.1. As part of your use of the Website we may provide you with a live chat facility, which is moderated by us and subject to controls. We reserve the right to review the chat and to keep a record of all statements made on the facility. Your use         
of the chat facility should be for recreational and socializing purposes.

 

9.2. We have the right to remove the chat room functionality or immediately terminate your Member Account and refund your account balance if you:

 

  • make any statements that are sexually explicit or grossly offensive, including expressions of bigotry, racism, hatred or profanity;
  • make statements about Operator's representatives that are abusive, defamatory or harassing or insulting;
  • use the chat facility to advertise, promote or otherwise relate to any other online entities;
  • make statements about the Website, or any other Internet site(s) connected to the Website that is untrue and/or malicious and/or damaging to Website;
  • use the chat facility to collude, engage in unlawful conduct or encourage conduct we deem seriously inappropriate.

 

9.3. Any suspicious chats will be reported to the competent authority.

 

9.4. Live Chat is used as a form of communication between us and you and should not be copied or shared with any forums, social media channels or third parties.

 

9.5. The maximum amount of money that can be withdrawn from a no deposit bonus (eg. cash-back, bonus money, complimentary free spins and other free awards) accounts to €1,000 and other currency equivalents. Any winnings resulting from such bonuses exceeding €1,000 might be kept by the management.
 

Example 1: The player is credited 100 free spins on Book of Dead. The player manages to win €5,000. From the €5,000 €4,000 will be kept by the management and €1,000 might be available for the player to withdraw.
 

Example 2: The player is credited a €50 bonus with x10 wagering. The player proceeds to win €6,500. €5,500 will be kept by the management and €1,000 might be available for the player to withdraw.
 

Example 3: If a player receives a cashback of €5,000 and subsequently wins an additional €20,000, management might keep €24,000.
 

Example 4: If a player wins €5,000 from 100 free spins on Book of Dead and then goes on to win an additional €20,000 from that amount, management might keep €24,000.

 

10. INTELLECTUAL PROPERTY RIGHTS

 

10.1. The Operator's trade name and logotype and all related trademarks, product and/or service names and slogans used for the gaming service are the property of the Operator and may not be used in any way without the prior written approval of         
the Operator. The customer's use of the gaming service shall not be construed as granting any license or right to use any trademarks or names appearing on the Operator's website or in connection with the gaming service without the prior written consent         
of the Operator or proper third party.

 

11. AMENDMENTS TO THE GAMING RULES OR TERMS AND CONDITIONS

 

11.1. The Operator shall make amendments to these Terms and Conditions at any time and without advanced notice.

 

11.2. If we make such amendments, we may take appropriate steps to bring such changes to your attention by email or placing a notice on the Website, but it shall be your sole responsibility to check for any amendments, updates and/or modifications.

 

12. BREACH OF AGREEMENT

 

12.1. If you breach any provision of these Terms and Conditions or we have a reasonable ground to suspect that you have breached them, we reserve the right to not open, to suspend, or to close your Member Account, or withhold payment of your winnings         
and apply such funds to any damages due by you.

 

13. RESOLVING COMPLAINTS

13.2. The Operator will use his best endeavor to resolve the matter within a reasonable time.

 

13.3. The Operator shall investigate any claim assigned from Estonian Tax and Customs Board or clients, related to the conduct of an Operator-organized game or the conduct of a representative of the Operator related to a game organized by the Operator.

 

14. SEVERABILITY

 

14.1. If any provision of these Terms and Conditions is held to be illegal or unenforceable, such provision shall be severed from these Terms and Conditions and all other provisions shall remain in force unaffected by such severance.

 

15. APPLICABLE LAW AND JURISDICTION

 

15.1. These Terms and Conditions are governed by the laws of the Republic of Estonia and the parties submit to the jurisdiction of the Harju County Court.
